Licensing (Scotland) Act 2005
The law is changing for those who sell alcohol within Scotland, as the Licensing (Scotland) Act 2005 comes into force. The new Act means that there will be a new system of premises licences for premises on which alcohol is sold, and a requirement for a personal licence. Applications for these new licences will need to be made to the correct Licensing Board.
Some of the questions you should be asking yourself are:
- Under the current licensing regime applicants are required to notify every occupier of premises situated in the same building of their proposed application. Will this remain the case?
- What is required to sell alcohol?
- Will applicants be required to set out in detail the times that activities may take place on the premises?
- Will premises be required to stay open for the full licensed hours applied for, as stated in the Act?
- What’s a personal licence?
- Who will be the designated premises manager?
- What happens if the premises manager leaves, will it be possible to continue selling alcohol on or from the premises?
- During what hours will alcohol be allowed to be served or sold
- What is the position regarding children?
- Will it be possible to vary the terms of a premises licence?
- What fees will be charged for applying for licences & renewals etc. under the Act?
- Will staff require training?
- When will the new system start?
